1. Scope and supplier

These general terms and conditions apply to all orders made via the online shop of Meyer–Hosen–AG (Hauptstrasse 30, 51580 Reichshof), accessible via the www.meyer–hosen.com domain.

MEYER–HOSEN–AG only supplies to consumers in the sense of § 13 German Civil Code who are resident /with delivery address in the Federal Republic of Germany and only in quantities which are usual in trade.

Consumer within the meaning of § 13 German Civil Code is any natural person who enters into a legal transaction which does not serve neither a commercial or independent vocational activity.

2. Contract conclusion

2.1 Contracts in the MEYER–HOSEN–AG online shop are only made in German.

2.2 The depiction of the products in the MEYER–HOSEN–AG online shop does not represent a legally binding offer but a non–binding online catalogue. The photographs and representations of the goods on offer on the internet site are created in the form of digital photographs of the actual existing goods. Any minor differences between the representations and reality do not represent a fault in the ordered goods. Unless explicitly stated in the item description, all items will be supplied without the pictured accessories (e.g. shoes). If a product is no longer available this will be pointed out.

2.3 By clicking the "Complete order" button at the end of the order process, you are placing a binding order of the goods which are in the shopping basket for the price which has been given to you. An automated e–mail will be sent immediately after your order has been received providing confirmation of receipt although it does not represent contract acceptance. MEYER–HOSEN–AG can accept your order by sending an order confirmation by e–mail or delivering the goods within five days. Contract conclusion only follows after such an order acceptance.

2.4 MEYER–HOSEN–AG is entitled not to accept online orders. The decision regarding this is at the discretion of MEYER–HOSEN–AG. If your online order is not fulfilled, please inform MEYER–HOSEN–AG immediately.

2.5 The text of a concluded contract is stored by MEYER–HOSEN–AG and can be sent to you, upon request, after completion of the order process. You can view your past orders in our customer log–in area.

3. Technical procedure during ordering

(Information obligation according to § 312c German Civil Code, article 246 § 3 Introductory Act to the German Civil Code)

3.1 Ordering takes place in three stages (selection of items for shopping basket, payment process and order completion) which are completed in several steps. In each ordering step you have the opportunity to return to the previous ordering step by means of the "Back" button. If you would like to make any changes, use the black button depicting the "spanner symbol" which is next to the data you have entered during the ordering process.

3.2 As customer you have the opportunity, by clicking the "In the shopping basket" button, to reserve one of your selected items until the end of the order process. A temporary information display window will inform you that the item which you have chosen is in the shopping basket and has been reserved.

3.3 You can proceed to the shopping basket by clicking the button "To shopping basket" or the text link "Shopping basket" which is on the top right side of the page. Here you have the opportunity to manage your reserved items, delete individual or all items in the basket or change the amount of the items to be ordered. Goods are only delivered in quantities which are usual in trade (see Figure 1 of these terms and conditions). To delete an item from the shopping basket, please click the "X" button next to the relevant item.

3.4 After you have checked the type and quantity of the items which are in the shopping basket, you have the opportunity to start the payment process by clicking the "Go to checkout" button.

3.5 Once you have entered the payment process in the so–called "Checkout area", you can first choose whether you would like to order the items in the shopping basket as a guest or as a user. If you would like to complete the order as a guest, you will be asked to enter the data needed for the bill and the delivery of the items, for example the name and address. All the requested data for the registration process is collected in strict compliance with our Data protection guidelines and will be treated confidentially. The completion of an order as a user requires the relevant registration in the MEYER–HOSEN–AG online shop. As a registered user you can benefit from the advantages of having your own user account (e.g. being able to view past orders etc). To do this, please register using the registration form. 3.6 Clicking the "Continue" button will lead you to an overview of the delivery costs and information about the logistics companies we use. Deliveries are in accordance with Figure 4 of these terms and conditions ("Delivery / delivery costs") and are free of delivery charges for users. This serves information purposes only.

3.7 Next, you can choose your preferred method of payment. You can find further information on payment options in Figure 5 of these terms and conditions. Depending on the payment provider, you will either be forwarded to the relevant service provider or will remain on the MEYER–HOSEN–AG online shop website. If you are forwarded to another website you will automatically return to the MEYER–HOSEN–AG online shop after you have entered the necessary details.

3.8 The last and final step, will lead you to an overview of the complete order. Here you can check the details you have provided again and change if necessary. By clicking the button "Complete order", you confirm the correctness of your details and are, with this, providing us with a binding order with this content.

4. Delivery / delivery costs

4.1 MEYER–HOSEN–AG supplies as long as stocks last. MEYER–HOSEN–AG is entitled to make part deliveries.

4.2 The logistics service provider is DPD Dynamic Parcel Distribution GmbH & Co. KG. Deliveries can only be made within Germany and are free of delivery charges. The goods are insured during the delivery and, if applicable, during the return delivery, in so far as they are in the possession of the service provider.

4.3 For delivery times, please see item data which can be found directly next to the respective product. If there is a delay in the delivery time, we will contact you immediately. You can follow the status of your delivery by means of the link Delivery tracking. If you are not there when the delivery arrives, the logistic service provider will leave a short written note in your letterbox. The parcel delivery firm will usually try to deliver your package for three consecutive days.

5. Prices and methods of payment

5.1 Prices given at the time of ordering apply. All prices include VAT, delivery costs and packaging.

5.2 Payment for the items purchased may be made either by means of an invoice, immediate bank transfer or PayPal. MEYER–HOSEN–AG is entitled to refuse certain payment methods depending on the credit check findings.

If paying by credit card, the sum will be reserved on your credit card when ordering (so–called authorisation). This occurs via the company Heidelberger Payment GmbH. The personal data required for this is saved locally with this company in a protected template. MEYER–HOSEN–AG does not save any of your credit card data. Your credit card is only charged with the sum when the goods are sent to you.

In the case of an immediate bank transfer, the sum with be charged to your account immediately.

If you choose payment upon invoice, the invoiced amount should be paid at the latest 14 days after receipt of the bill which is sent with the goods. If you have already returned individual items of an invoiced order, the price of the returned items may be deducted from the total invoice sum.

6. Reservation of rights

Goods remain the property of MEYER–HOSEN–AG until the full payment has been received.

Cancellation notice

Right of rescission
You may withdraw from the contract within 14 days without stating any reasons for this in text form (e.g. letter, fax or e–mail) or by returning the goods. The period begins upon receipt of this notice in text form although not before the recipient has received the goods (in the case of the recurring supply of similar goods, not before receipt of the first part delivery) and also not before fulfilment of our information obligations according to article 246 § 2 in association with § 1 para. 1 and 2 Introductory Act to the German Civil Code as well as our obligations according to § 312g para. 1 section 1 German Civil Code in association with the 246 § 3 Introductory Act to the German Civil Code. The cancellation period is observed by the timely sending of the cancellation notice or dispatching of the goods.

Consequences of cancellation

In the case of an effective cancellation, the services received by both parties must be returned and, if applicable, any benefits made (e.g. interest). If you are unable to return the received goods or any benefits (e.g. consumer benefits) or can only partly return these or in a worsened condition, you must offer compensation for this of equal value. In the case of a deterioration of the goods and for any benefits made, you will only have to make a compensation of equal value in so far as the benefits or the deterioration can be traced back to the handling of the goods which goes beyond an examination of the properties and the functioning. "Examination of properties and functioning" is understood to mean the testing and trying on of the respective goods as is usually possible in a store. Goods which can be sent as a parcel can be returned at our risk. You must assume the standard costs of the return if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed 40 euros or, if the price is more than this, you have not yet rendered the service in return or the contractually agreed part payment. Otherwise, the return is free of charge to you. Goods which cannot be returned by parcel delivery will be collected from you. Any obligations with regard to reimbursement of payments must be made within 30 days. The period starts for you with the sending of your letter of cancellation or the goods and, for us, it begins with the receipt of these.

7.2 If you intend to return goods, please notify us either by telephone: Tel. +49 (0) 2296 9812 390 or by e–mail service@meyer–hosen.com. This allows us to assign the products as quickly as possible. However, such notification is not essential for you to exercise your right of cancellation.

8. Guarantee

Unless agreed otherwise, the legal guarantee provisions apply.

9. Final provisions

In the event that a provision of these general terms and conditions becomes invalid, the remaining legal provisions still apply.

10. Copyright and trademarks

The website is the property of MEYER–HOSEN–AG, Hauptstraße 30, 51580 Reichshof–Denklingen which operates the site. The entire content of the website including texts, graphics, photos, images, moving images, sounds, illustrations and software (subsequently referred to as "CONTENT") is the property of MEYER–HOSEN–AG, its licensees and/or content providers. All elements of the website including the general designs and the content, are protected by copyrights and other rights. Unless stated otherwise on the website, any reproduction, re–working, translation, storing, processing of content, in particular the use of image and text material on platforms such as ebay/amazon, is not permitted.

All trademarks, service brands and brand names used here are, unless stated otherwise, a registered trademark. The MEYER trademark is the own brand of MEYER–HOSEN–AG. It is not permitted to use, duplicate, reproduce, send, transfer, distribute, change, publish or upload this trademark in any way without the prior written consent of MEYER–HOSEN–AG.
